Terms of Service

1. Agreement

By using Mulch ("we," "us," or "our"), you ("you" or the "Customer") agree to these Terms of Service. If you do not agree, do not use the service. This is a template and should be reviewed by legal counsel before publishing.

2. The Service

Mulch provides automated lead response, qualification, and scheduling services for landscaping businesses, including voice and text agents that respond to inbound leads on your behalf.

3. Your Account

You are responsible for the accuracy of information you provide, for keeping your credentials secure, and for all activity under your account. You must be authorized to receive calls, texts, and leads on behalf of the business you register.

4. Fees & Billing

Fees, billing terms, and payment schedules are set out in your signed order form. Fees are non-refundable except as expressly stated in our written guarantee. You authorize us to charge your payment method for recurring fees.

5. Guarantee

Our 90-day guarantee is described on the Guarantee page and is the sole and exclusive remedy for the performance covered by that guarantee. Eligibility requirements and exclusions listed there apply.

6. Acceptable Use

You will not use Mulch to violate any law, transmit unlawful or harmful content, harass third parties, or circumvent applicable communications regulations (including TCPA, CAN-SPAM, and similar rules where they apply).

7. Termination

Either party may terminate for material breach that remains uncured after 30 days' written notice. We may suspend the service immediately if usage threatens the security or integrity of our systems.

8. Disclaimers

The service is provided "as is" and "as available." We do not warrant that inbound lead volume, close rates, or specific revenue outcomes will result from using Mulch. We disclaim all implied warranties to the fullest extent permitted by law.

9. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability arising out of or related to the service will not exceed the fees you paid to us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

10. Changes

We may update these Terms from time to time. Continued use of the service after changes take effect constitutes acceptance of the revised Terms.
